data-contrast=\"auto\">de forma setorial, departamental, parcial ou na totalidade dos postos de trabalho,\u00a0<\/span><span data-contrast=\"auto\">por at\u00e9 120 dias,\u00a0<\/span><span data-contrast=\"auto\">contados da publica\u00e7\u00e3o da medida provis\u00f3ria mencionada, salvo se houver prorroga\u00e7\u00e3o\u00a0<\/span><span data-contrast=\"auto\">atrav\u00e9s de\u00a0<\/span><span data-contrast=\"auto\">ato posterior.<\/span><span data-contrast=\"auto\">Para se\u00a0<\/span><span data-contrast=\"auto\">obter<\/span><span data-contrast=\"auto\">\u00a0o valor do sal\u00e1rio-hora do empregado, \u00e9 necess\u00e1rio dividir o seu sal\u00e1rio<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">base<\/span><span data-contrast=\"auto\">\u00a0mensal pela carga hor\u00e1ria mensal respectiva.<\/span><span data-contrast=\"auto\">Por exemplo, para um empregado que trabalha 44 horas semanais, a sua carga hor\u00e1ria mensal \u00e9 de 220 horas (j\u00e1 que o repouso semanal \u00e9 remunerado). Assim, para uma pessoa que ganha R$ 1.000,00 (<\/span><span data-contrast=\"auto\">hum<\/span><span data-contrast=\"auto\">\u00a0mil reais), o valor do sal\u00e1rio-hora ser\u00e1 de R$ 4,5454.<\/span><span data-contrast=\"auto\">Ao se reduzir a jornada do empregado com a redu\u00e7\u00e3o do sal\u00e1rio, esta redu\u00e7\u00e3o deve ser proporcional \u00e0quela, de forma que o sal\u00e1rio-hora seja preservado.<\/span><span data-contrast=\"auto\">(a) os empregados auferirem sal\u00e1rio igual ou inferior a R$ 3.<\/span><span data-contrast=\"auto\">300,00<\/span><span data-contrast=\"auto\">\u00a0(art. 12, data-contrast=\"auto\">(b) os empregados forem portadores de diploma de n\u00edvel superior e perceberem sal\u00e1rio mensal bruto igual ou superior a R$ 12.<\/span><span data-contrast=\"auto\">867,14<\/span><span data-contrast=\"auto\">\u00a0(duas vezes o limite m\u00e1ximo dos benef\u00edcios do Regime Geral de Previd\u00eancia Social) (art. 12, II);<\/span><span data-contrast=\"auto\">sejam<\/span><span data-contrast=\"auto\">\u00a0no percentual de 25% (art. 12<\/span><span data-contrast=\"auto\">, \u00a7, I<\/span><span data-contrast=\"auto\">).<\/span><span data-contrast=\"auto\">(d) empregados de qualquer faixa salarial, quando do acordo n\u00e3o resultar diminui\u00e7\u00e3o do valor total recebido mensalmente pelo empregado, inclu\u00eddos neste valor o Benef\u00edcio Emergencial de Manuten\u00e7\u00e3o do Emprego e da Renda<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0a ajuda compensat\u00f3ria mensal e sal\u00e1rio pago pelo empregador em raz\u00e3o das horas trabalhadas pelo Empregado (art. 12, \u00a7, II).<\/span><span data-contrast=\"auto\">\u00a0(acordo coletivo ou conven\u00e7\u00e3o coletiva do trabalho) para os demais casos.<\/span><span data-contrast=\"auto\">Ou seja,\u00a0<\/span><span data-contrast=\"auto\">n\u00e3o se enquadrando em uma das hip\u00f3teses de acordo individual,\u00a0<\/span><span data-contrast=\"auto\">a redu\u00e7\u00e3o da jornada e do sal\u00e1rio deve se dar atrav\u00e9s de negocia\u00e7\u00e3o coletiva<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">(iii) percentuais de redu\u00e7\u00e3o<\/span><\/b><b><span data-contrast=\"auto\">\u00a0e encaminhamento da proposta com anteced\u00eancia<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Como terceiro requisito, a MP disp\u00f5e que os percentuais de redu\u00e7\u00e3o no caso de\u00a0<\/span><span data-contrast=\"auto\">acordo individual\u00a0<\/span><span data-contrast=\"auto\">escrito (art. 7\u00ba, III) devem ser, exclusivamente, nos percentuais de 25%, 50% e 70%, n\u00e3o tendo deixado margem para que, nesta hip\u00f3tese (de acordo individual), a redu\u00e7\u00e3o ocorra em percentuais distintos.<\/span><span data-contrast=\"auto\">J\u00e1 para a hip\u00f3tese de redu\u00e7\u00e3o por meio de\u00a0<\/span><span data-contrast=\"auto\">negocia\u00e7\u00e3o coletiva<\/span><span data-contrast=\"auto\">, a MP disp\u00f5e que as partes t\u00eam ampla liberdade para fixar o percentual de redu\u00e7\u00e3o dos sal\u00e1rios e da jornada de trabalho (art. 11, \u00a7 1\u00ba).<\/span><span data-contrast=\"auto\">Tamb\u00e9m est\u00e1 previsto que o encaminhamento da proposta de acordo ao empregado dever\u00e1 ser feito com anteced\u00eancia de, no m\u00ednimo, dois dias corridos (art. 7\u00ba, III).<\/span><span start=\"2\">\n<li><b><span data-contrast=\"auto\"> Suspens\u00e3o Tempor\u00e1ria do Contrato de Trabalho<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"auto\">No art. 8\u00ba da MP ficou prevista a possibilidade de suspens\u00e3o tempor\u00e1ria do contrato de trabalho<\/span><span data-contrast=\"auto\">, de forma setorial, departamental, parcial ou na totalidade dos postos de trabalho,\u00a0<\/span><span data-contrast=\"auto\">tamb\u00e9m por at\u00e9 120 dias<\/span><span data-contrast=\"auto\">\u00a0e<\/span><span data-contrast=\"auto\">\u00a0contados da dever\u00e1\u00a0<\/span><b><span data-contrast=\"auto\">informar a ado\u00e7\u00e3o destas medidas, ao Minist\u00e9rio da Economia, no prazo de 10 (dez) dias,<\/span><\/b><span data-contrast=\"auto\">\u00a0contado da data da celebra\u00e7\u00e3o do acordo, de forma que a primeira parcela do Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda ser\u00e1 paga ao empregado, pela Uni\u00e3o, atrav\u00e9s do Minist\u00e9rio da Economia, no prazo de trinta dias, contado da data da celebra\u00e7\u00e3o do acordo.<\/span><span trabalho e n\u00e3o venha informar a ado\u00e7\u00e3o destas medidas ao Minist\u00e9rio da Economia no prazo previsto (dez dias contado da data da celebra\u00e7\u00e3o do acordo), ele (i) ficar\u00e1 respons\u00e1vel pelo pagamento da remunera\u00e7\u00e3o no valor anterior \u00e0 ado\u00e7\u00e3o destas medidas (redu\u00e7\u00e3o da jornada de trabalho e de sal\u00e1rio ou da suspens\u00e3o tempor\u00e1ria do contrato de trabalho do empregado), inclusive dos respectivos encargos sociais<\/span><span data-contrast=\"auto\">\u00a0e trabalhistas<\/span><span data-contrast=\"auto\">, at\u00e9 que a informa\u00e7\u00e3o seja prestada.<\/span><span prestada\u00a0<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">\u00a0informa\u00e7\u00e3o, sendo a primeira parcela paga no prazo de trinta dias, e o benef\u00edcio ser\u00e1 devido pelo restante do per\u00edodo pactuado (art. 5\u00ba, \u00a7 3\u00ba).<\/span><span
