e\u00a0<\/span><span data-contrast=\"none\">jornada\u00a0 e<\/span><span data-contrast=\"none\">\u00a0para a suspens\u00e3o tempor\u00e1ria do contrato de trabalho, durante o estado de calamidade p\u00fablica (<\/span><span data-contrast=\"none\">arts<\/span><span data-contrast=\"none\">. 7\u00ba e 8\u00ba da Lei 14.020\/2020), para 120 dias.<\/span><span redu\u00e7\u00e3o\u00a0<\/span><span data-contrast=\"auto\">proporcional de jornada e de sal\u00e1rio e de suspens\u00e3o tempor\u00e1ria do contrato de trabalho, bem como para que o Governo efetue o pagamento dos benef\u00edcios emergenciais de que trata a Lei n\u00ba 14.020, de 06\/07\/2020.<\/span><span data-contrast=\"auto\">A Lei n\u00ba 14.020<\/span><span data-contrast=\"none\">\/2020<\/span><span data-contrast=\"none\">\u00a0resultou da aprecia\u00e7\u00e3o, pelo Congresso Nacional, da\u00a0<\/span><span data-contrast=\"none\">medida provis\u00f3ria n\u00ba 936\/2020<\/span><span data-contrast=\"none\">, que instituiu o Programa Emergencial de Manuten\u00e7\u00e3o do Emprego e da Renda, dispondo, entre outras coisas, sobre redu\u00e7\u00e3o proporcional de jornada e de sal\u00e1rio e de suspens\u00e3o tempor\u00e1ria do contrato de trabalho.<\/span><span data-contrast=\"none\">Os prazos de dura\u00e7\u00e3o m\u00e1xima\u00a0<\/span><span data-contrast=\"auto\">estabelecidos na Medida Provis\u00f3ria 936\/2020 e na Lei 14.020\/2020 foram\u00a0<\/span><span data-contrast=\"auto\">de<\/span><span data-contrast=\"auto\">\u00a090 (noventa) dias para a redu\u00e7\u00e3o proporcional de sal\u00e1rio e jornada e<\/span><span data-contrast=\"auto\">\u00a060 (sessenta) dias para a suspens\u00e3o tempor\u00e1ria do contrato de trabalho, durante o estado de calamidade p\u00fablica (<\/span><span data-contrast=\"auto\">arts<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">7<\/span><span data-contrast=\"auto\">\u00ba e\u00a0<\/span><span data-contrast=\"auto\">8<\/span><span data-contrast=\"auto\">\u00ba<\/span><span data-contrast=\"auto\">)<\/span><span data-contrast=\"auto\">,\u00a0<\/span><span data-contrast=\"auto\">com a\u00a0<\/span><span data-contrast=\"auto\">possibilidade de amplia\u00e7\u00e3o destes prazos atrav\u00e9s de ato do Poder Executivo<\/span><span data-contrast=\"auto\">que amb<\/span><span data-contrast=\"auto\">as as medidas\u00a0<\/span><span data-contrast=\"auto\">poder<\/span><span data-contrast=\"auto\">iam\u00a0<\/span><span data-contrast=\"auto\">ter a dura\u00e7\u00e3o\u00a0<\/span><span data-contrast=\"auto\">m\u00e1xima\u00a0<\/span><span data-contrast=\"auto\">de 120 (cento e vinte) dias<\/span><span data-contrast=\"none\">oram\u00a0<\/span><\/b><b><span data-contrast=\"none\">acrescidos\u00a0<\/span><\/b><b><span data-contrast=\"none\">s<\/span><\/b><b><span data-contrast=\"none\">essenta dias<\/span><\/b><span data-contrast=\"none\">\u00a0aos\u00a0<\/span><span data-contrast=\"none\">prazos\u00a0<\/span><span data-contrast=\"none\">m\u00e1ximos\u00a0<\/span><span data-contrast=\"none\">j\u00e1 antes estabelecidos\u00a0<\/span><span data-contrast=\"none\">para celebrar acordo de redu\u00e7\u00e3o proporcional da jornada de trabalho e de sal\u00e1rio e de suspens\u00e3o tempor\u00e1ria de contrato de trabalho<\/span><span data-contrast=\"none\">.<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">Dessa forma, h<\/span><span data-contrast=\"none\">avendo\u00a0<\/span><span data-contrast=\"none\">acordos de\u00a0<\/span><span data-contrast=\"none\">suspens\u00e3o tempor\u00e1ria do contrato de trabalho e redu\u00e7\u00e3o proporcional de jornada e sal\u00e1rio<\/span><span data-contrast=\"none\">\u00a0com rela\u00e7\u00e3o a um mesmo empregado<\/span><span data-contrast=\"none\">,\u00a0<\/span><span data-contrast=\"none\">somados\u00a0<\/span><span data-contrast=\"none\">os per\u00edodos<\/span><span data-contrast=\"none\">\u00a0sucessivos ou\u00a0<\/span><span data-contrast=\"none\">intercalados<\/span><span data-contrast=\"none\">,<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">o prazo m\u00e1ximo ser\u00e1 de\u00a0<\/span><span data-contrast=\"none\">180\u00a0<\/span><span data-contrast=\"none\">(cento e\u00a0<\/span><span data-contrast=\"none\">oitenta<\/span><span data-contrast=\"none\">) dias<\/span><span data-contrast=\"none\">,\u00a0<\/span><span data-contrast=\"none\">observada a\u00a0<\/span><span data-contrast=\"none\">dura\u00e7\u00e3o do estado de calamidade p\u00fablica a que se refere o art. 1\u00ba da Lei n\u00ba 14.020, de 2020<\/span><span data-contrast=\"none\">.<\/span><span data-contrast=\"auto\">Da mesma forma que o art. 5\u00ba do Decreto 10.422\/2020, o\u00a0<\/span><span data-contrast=\"auto\">\u00a0art.\u00a0<\/span><span data-contrast=\"auto\">4\u00ba\u00a0<\/span><span data-contrast=\"auto\">do Decreto<\/span><span data-contrast=\"auto\">\u00a0n\u00ba 10.470\/2020<\/span><span data-contrast=\"auto\">\u00a0previu que os per\u00edodos de redu\u00e7\u00e3o proporcional de jornada e de sal\u00e1rio ou de suspens\u00e3o tempor\u00e1ria do contrato de trabalho<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0utilizados at\u00e9 a data de publica\u00e7\u00e3o deste\u00a0<\/span><span data-contrast=\"auto\">\u00faltimo\u00a0<\/span><span data-contrast=\"auto\">Decreto<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0seriam computados para fins de contagem dos limites m\u00e1ximos resultantes do acr\u00e9scimo de prazos de que tratam os demais dispositivos antes citados.<\/span><span data-contrast=\"auto\">Lei n\u00ba 14.020\/2020<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">previu que os empregados que firmassem acordos de redu\u00e7\u00e3o proporcional de jornada e sal\u00e1rio ou suspens\u00e3o tempor\u00e1ria do contrato de emprego, receberiam<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">pagamento do Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda<\/span><span data-contrast=\"auto\">\u00a0(art<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a05\u00ba)<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">O art. 6\u00ba do Decerto 10.470\/2020<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">repetiu a previs\u00e3o do\u00a0<\/span><span data-contrast=\"auto\">art. 7\u00ba do Decreto\u00a0<\/span><span data-contrast=\"auto\">n\u00ba 10.422\/2020<\/span><span data-contrast=\"auto\">\u00a0de que a\u00a0<\/span><span data-contrast=\"auto\">concess\u00e3o e pagamento do\u00a0<\/span><span data-contrast=\"auto\">Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda<\/span><span data-contrast=\"auto\">\u00a0previstos na Medida Provis\u00f3ria 936\/2020, convertida na Lei 1<\/span><span data-contrast=\"auto\">4<\/span><span data-contrast=\"auto\">.020\/2020 (art. 5\u00ba),\u00a0<\/span><span data-contrast=\"auto\">observadas as prorroga\u00e7\u00f5es\u00a0<\/span><span data-contrast=\"auto\">de prazo\u00a0<\/span><span data-contrast=\"auto\">nele previst<\/span><span data-contrast=\"auto\">as<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">ficam condicionados \u00e0s disponibilidades or\u00e7ament\u00e1rias.<\/span><span data-contrast=\"auto\">Como j\u00e1 dissemos em artigo anterior, a<\/span><span data-contrast=\"auto\">\u00a0previs\u00e3o do Decreto neste sentido n\u00e3o poder\u00e1 atingir o pagamento do Benef\u00edcio Emergencial de Preserva\u00e7\u00e3o do Emprego e da Renda relativo ao per\u00edodo de dura\u00e7\u00e3o das medidas prevista na Lei n\u00ba 1<\/span><span data-contrast=\"auto\">4<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">0<\/span><span data-contrast=\"auto\">20\/2020, uma vez que neste \u00faltimo diploma legal n\u00e3o havia semelhante restri\u00e7\u00e3o<\/span><span data-contrast=\"auto\">.
